Legal learning event on the Prevention of Sexual Exploitation, Abuse and Harassment
Tirsdag 08 Oktober 2019, 09:00 - 12:00

Red Cross and Global Focus invite to a legal learning event on the Prevention of Sexual Exploitation, Abuse and Harassment.

Who is the course relevant for: The course is aimed at HR-staff, compliance staff or other staff with the responsibility for developing safeguarding policies and procedures and handling cases of sexual misconduct within their organisation.

Aim: The purpose of this legal learning event is to equip staff with a basic understanding of how to handle the legal dilemmas which arise in an HR context when creating a strengthening Prevention of Sexual Exploitation, Abuse, and Harassment (PSEA&H) set up in an organisation. To this aim, Attorney at Law Christoffer Lambert-Züberlein will guide us though the framework governing the use of information in a PSEA&H set up and the do’s and don’ts when considering and developing policies and procedures on PSEA&H., including:

  • Referencing: What are the legal limits when it comes to giving references on staff that has been found guilty of committing sexual misconduct through an administrative procedure?
  • GPDR: what limits are set by the GDPR?
  • What do we need to be aware of in relation to good governance when handling and investigating sexual misconduct cases
  • Screenings of staff: what legal issues do we have to be aware of?
  • When do we report to the police and what should we be aware of?
  • What are the possibilities of investigating cases abroad?

Christoffer Lambert-Züberlein specializes in employment and labor law and data protection.

Background: Global Focus, and member organisations has in a working group worked on developing different strategies to create operational changes within the Danish NGO-sector on PSEA&H. The working group has agreed upon a set of Commitments that set out a best practice standard for having a strong PSEA&H set-up in an organisation. In this connection, the commitments address issues such as improvement of the Code of Conducts, reporting mechanisms, investigations, hiring procedures and safeguarding.
